An Accra High Court has dismissed the mandamus application filed by Member of Parliament for South Dayi, Rockson-Nelson Dafeamekpor, seeking to compel President Akufo-Addo to assent or otherwise the anti-LGBTQ Bill passed by Parliament.
The court, presided over by Justice Ellen Mireku, ruled that although it had jurisdiction, it would exercise its discretionary powers to dismiss the application. The dismissal came after arguments from lawyers for the Attorney-General, represented by Chief State Attorney Sylvia Adeso, who contended that the High Court had no jurisdiction to grant the application.
Justice Mireku noted that two suits filed by private citizens Prof Amanda Odoi and Richard Dela Sky had direct implications on the mandamus application. Consequently, she declined the reliefs being sought by the South Dayi member of Parliament.
